This is not a story about buying property. It is a story about the people who already did, years ago, and who are now sitting on a residency visa that the Colombian government considers legacy paperwork. If that is you, you have until the end of October to fix it, and almost nobody has told you in English.
On 27 September 2024 the Ministerio de Relaciones Exteriores issued Resolución 9316 de 2024. Article 3 of that resolution extended a deadline buried in the third paragraph of article 123 of Resolución 5477 de 2022, the regulation that rebuilt Colombia's entire visa architecture into the current M, R, and V categories. The extension runs to 31 October 2026.
What it requires is a traspaso: a formal transfer of your existing Residente Permanente visa onto the current regulatory framework, filed with the Autoridad de Visas. It applies to residency visas granted under the regulations that preceded Resolución 5477, which in practice means Resolución 6045 de 2017 and everything before it. If your R visa was stamped before October 2022, this almost certainly means you.
The traspaso is a prerequisite for Migración Colombia issuing your cédula de extranjería. The cédula is the document that a Colombian notary, bank, and utility company all use to identify you. No valid cédula means no clean signature on an escritura, complications on a mortgage or a bank account, and friction on every administrative act attached to property you already own. The residency problem becomes a property problem faster than most owners expect.
Who this applies to, precisely
The transition regime is narrower than the panicked forum posts suggest. Work through it honestly:

The uncomfortable cases are the long-settled residents who genuinely do not remember. People who arrived in 2015, got residency, bought an apartment in Laureles, and have not thought about Migración since their last cédula renewal. Those are exactly the people the transition regime was written for, and exactly the people least likely to be reading Cancillería press releases.
What changed, and one thing that got easier
Resolución 9316 modified articles 106, 118, and 123 of Resolución 5477. Two effects matter to you:
- The deadline moved to 31 October 2026. This was an extension, not a new obligation. The requirement existed from 2022; the date has been pushed back once already, which is precisely why so many people assume it will be pushed again.
- The salvoconducto requirement was removed. Under the earlier procedure, applicants had to produce a salvoconducto as part of the traspaso file. Resolución 9316 eliminated that step, which removed one of the more irritating bottlenecks from the process.
The 2024 extension is the reason for widespread complacency. It is a poor basis for planning. The Cancillería issued a fresh public reminder in March 2026 restating the October date and explicitly linking it to cédula issuance, which is not the behaviour of an agency preparing to move the goalposts again. Treat 31 October 2026 as real and file early enough that a document problem does not become a missed deadline.
What happens if you miss it
This is where the stakes stop being administrative. Under the transition regime, a visa whose traspaso is not completed can have its validity treated as terminated, in the same manner as failing the ordinary five-year transfer obligation. Article 111 of Resolución 5477 then gives you 30 days in regular migratory status, during which you must either leave Colombia or apply for a new visa.
For a property owner, that sequence is genuinely expensive:
- Your cédula lapses. Migración Colombia issues the cédula off the back of a valid, current visa. No traspaso, no renewal.
- Notarial acts get complicated. Selling, gifting, granting a power of attorney, or signing an escritura all require valid identification. A foreigner with a lapsed cédula is not a person a notary processes quickly.
- Banking friction compounds. Colombian banks re-verify identity documents. An expired cédula can freeze the account you use to pay predial and administración.
- Re-applying means current thresholds. If you fall out of status and must apply fresh under an investment route, you face today's SMMLV-indexed numbers, not the ones that applied when you first qualified. None of this costs you the apartment. Colombian law does not strip foreigners of property for immigration lapses, and your title is unaffected. What it costs you is the ability to act on the apartment conveniently, at exactly the moment you might need to.
How the process actually runs
The Cancillería has been explicit that the process is completed online through the Ministry's own platform, and that no intermediary is required. Treat any WhatsApp contact promising privileged access as what it is.
- Identify your issuing resolution. Look at the visa. If it predates October 2022, you are in scope. This one step resolves most of the uncertainty people carry for months.
- Assemble the general visa application requirements. The traspaso is processed as a visa application, so the standard documentary set applies: valid passport, photograph, the current form, and proof of the qualifying condition your original residency rested on.
- Pull a certificado de movimientos migratorios. Issued by Migración Colombia, this evidences your entry and exit history. It is a routine but non-optional piece of the file.
- File through the official Cancillería platform. Online, direct, no agent needed. Fees are set by resolution and revised periodically, so check the current figures on the official channel rather than trusting a number in a blog post, including this one.
- Once the visa issues, register with Migración Colombia for the cédula. This is the step the whole deadline exists to protect. Registration deadlines after visa issuance are short, so do not let the new visa sit in your inbox.
The honest recommendation
If your file is clean, this is a self-service process and paying a lawyer four figures to click through a government portal is poor value. Most straightforward traspasos do not need representation.
Get a Colombian immigration attorney involved when any of the following is true: you cannot determine which resolution issued your visa, your original qualifying condition has since changed, there is a gap or irregularity in your migratory history, your family members hold beneficiary visas that need to move with yours, or you are inside sixty days of the deadline with an incomplete file. Those are the situations where a few hundred dollars of professional time is cheap insurance against a 30-day exit clock.

Resolución 9316 de 2024 gives holders of pre-2022 Residente Permanente visas until 31 October 2026 to complete the traspaso. The process is online, the salvoconducto requirement is gone, and the consequence of ignoring it is a lapsed cédula and a 30-day window to leave or reapply.
